April 22, 2004 HB 1040 - Licensure Exemption for All Educational Interpreters

The Missouri Commission for the Deaf and Hard of
Hearing has just learned that SCS HCS HB 1040 contains language
added by the Senate Education Committee that would completely exempt
all educational interpreters in Missouri from all the licensing
requirements found in 209.319 to 209.339, RSMo, thus freeing them
from any requirement to be certified, obtain a license, obtain
annual CEUs, adhere to the Skill Level Standards rule, or follow the
Ethical Rules of Conduct for Interpreters. The added language reads
as follows:
"6. A person who is an employee or independent contractor of a
Missouri public school district and is providing interpreting as
part of special education, related services, or supplementary aids
and services for students with disabilities, subject to the
requirements of state and federal law, shall be exempt from the
provisions of section 209.319 to 209.339."
This bill has already passed the House, and has been voted "Do Pass"
by the Senate Education Committee. This provision (section
209.321.6) is strongly opposed by the Missouri Commission for the
Deaf as it would result in serious harm to deaf students in Missouri
schools. All advocates who would like to see this bill changed
should immediately contact the chair of the Senate Education
Committee and let him know that you are strongly opposed to section
209.321.6 of SCS HCS HB 1040. The chair of the Senate Education
